What Is the Difference Between DWI and DWAI?

In New York, there are two main types of drunk driving charges: driving while intoxicated (DWI) and driving while ability impaired (DWAI). The primary difference between these two charges is the driver’s blood alcohol content (BAC) level at the time of the arrest.

Under New York law, the following BAC levels apply:

  • 0.08% or higher for drivers 21 years of age and older
  • 0.04% or higher for commercial drivers
  • 0.02% or higher for drivers under the age of 21

If a driver’s BAC is between 0.05% and 0.07%, he or she may be charged with DWAI. If the driver’s BAC is 0.08% or higher, he or she may be charged with DWI. If the driver’s BAC is 0.18% or higher, he or she may be charged with aggravated DWI, which is a more serious offense.

What Are the Penalties for DWI in New York?

When a driver is convicted of DWI in New York, he or she may face both criminal and administrative penalties. The specific penalties depend on the circumstances of the case, including the driver’s BAC level, whether anyone was injured, and whether the driver has any prior DWI convictions.

Criminal penalties for DWI in New York include:

  • Up to 1 year in jail for a first offense
  • Up to 4 years in prison for a second offense
  • Up to 7 years in prison for a third offense
  • Up to 15 years in prison for a fourth or subsequent offense
  • Fines ranging from $500 to $10,000
  • License suspension for at least 6 months
  • Installation of an ignition interlock device (IID) for at least 1 year

In addition to these criminal penalties, a driver convicted of DWI may also face administrative penalties, such as the revocation of his or her driver’s license. If the driver caused an accident while under the influence, he or she may also be held liable for the victim’s damages.
